Your rights come first
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law. Where anything below conflicts with those rights, your rights win.
These terms are between you and KATA GROUP PTY LTD (ABN 12 636 119 198).
Prices
All prices are in Australian dollars and include GST. The price you see is the price you pay for the goods; delivery is shown separately before you confirm.
Prices can change. The price that applies to your order is the one shown when you place it, and it is confirmed in your order confirmation.
If we list something at an obviously wrong price and you order it, we will contact you before doing anything: we will either honour the price or cancel and refund you in full. We will not charge you a different price without your agreement.
Orders and acceptance
Placing an order is an offer to buy. A contract forms when we confirm the order. If we cannot supply something after confirming — because stock ran out between your order and our supplier picking it — we will tell you promptly and refund that line in full.
Stock figures on this site come from our distributors and are refreshed regularly, but they are indicative rather than a reservation.
Delivery
We deliver across Australia. Delivery estimates are estimates, not guarantees, unless we have said otherwise in writing for your order.
Risk in the goods passes to you on delivery. If something arrives damaged, that is our problem to resolve, not yours — tell us and we will sort it out.
Cancelling and changing your mind
You can cancel an order at no cost any time before it is dispatched. Once it has shipped, a change-of-mind return is covered by our returns policy: 30 days, unopened and in resaleable condition, return postage at your cost.
That 30-day window is a courtesy we offer in addition to your legal rights. It has nothing to do with a faulty product, which has no such time limit.
Faults and consumer guarantees
Goods must be of acceptable quality, match their description, and be fit for any purpose we told you they were fit for. If they are not, you are entitled to a repair, replacement or refund, depending on how serious the problem is — and for a major failure the choice is yours, not ours.
This applies regardless of any manufacturer warranty, and regardless of what any of our suppliers are prepared to do for us. A supplier declining to take stock back is our commercial problem, not a reason to refuse you.
Business customers
Where you buy as a business, contract pricing, purchase-order handling and any invoice terms are set out in your account and prevail over the general terms above to the extent they differ.
Consumer guarantees still apply to most business purchases of goods normally acquired for personal or domestic use, and to any goods under $100,000, regardless of who is buying.
Liability
Our liability for a failure to comply with a consumer guarantee is as set out in the Australian Consumer Law and is not limited by these terms.
Otherwise, and to the extent the law allows, we are not liable for indirect or consequential loss, and our liability is limited to the amount you paid for the goods concerned.
Governing law
These terms are governed by the law of the Australian state or territory in which we are based, and the courts there have jurisdiction. This does not affect any right you have to bring a matter in your own state.
